Defence demonstrated thevmother had a motive to influence her daughter to come forward with the allegations.vDefence cross-examined the wife and showed the timing of the daughter’svcomplaint coincided with the wife’s escalation of family court proceedings against client, including demands for money. The charges were dismissed after a trial.
Charges for possessing and accessing child pornography stayed
P.K. was charged with accessing child pornography and possession of cocaine. Due to unreasonable delay caused by late disclosure by the crown, defence successfully argued that P.K.’s speedy trial rights were infringed and his charges was stayed (dismissed).
Possession for the purpose of trafficking charge withdrawn
A.A. was charged with possession for the purpose of trafficking in cocaine, fentanyl and crystal meth. After providing a statutory declaration swearing that the drugs did not belong to her (and therefore must have belonged to her roommate), her charges were withdrawn
Charges of domestic assault and sexual assault stayed for unreasonable delay
R.B. was charged with assault, and a number of sexual assaults against his girlfriend, that allegedly occurred over a six-month period. Defence successfully cross-examined the complainant and demonstrated she was not a believable witness. Defence application to dismiss charges (stay of proceedings) was granted due to unreasonable delay in the matter after successful defence applications for access to complainant’s therapeutic records.
Client found not guilty in historical sexual assault charge
A.M. was charged with historical sexual assaults on his niece from 15 years prior. She claimed the sexual assaults occurred while A.M.’s daughter was present in the room. Defence raised a doubt by calling evidence that the daughter could not have been present in the house at the time, notwithstanding his daughter was not available to testify. The client was found not guilty.
Arson charge lowers to mischief after paying restitution
T.P. was charged with arson resulting in over one million dollars in damages to property. After paying minimal restitution, and obtaining counselling for bi-polar disorder, T.P. pleaded guilty to mischief and received a conditional discharge. No criminal record.
Sexual assault acquittal after trial
B.B. was charged with sexual assault for allegedly putting his hand up the complainant’s skirt and touching her genitals. B.B. was acquitted at trial after defence demonstrated through focused and thorough cross-examination that she lacked credibility in her claim she was touched inappropriately.
Absolute discharge for client charged with careless use of a firearm
M.T. was charged with careless use of a firearm. While drunk, he went back to his neighbour’s home, after being refused entry to join him and his family for dinner. The client displayed a semi-automatic rifle with ammunition. He completed alcohol/substance abuse counselling and received a positive report. The client pleaded guilty and received an absolute discharge (no criminal record).

S.A. was charged with sexually assaulting his younger sister. Defence applied for and obtained disclosure of the sister’s psychiatric records, which indicated she had multiple personality disorder. The charges were subsequently withdrawn.

Charge of leaving the scene of an accident withdrawn
A.C. was charged with leaving the scene of an accident under the Criminal Code. Video evidence showed the client hit a pedestrian, who was thrown into the air, and landed on the sidewalk. The charge was withdrawn because the defence had demonstrated the client’s right to privacy in her jail cell was violated.
Sexual assault charge dismissed
S.A. was charged with sexual assault on a woman he met online. They had a short consensual sexual relationship. She alleged he then sexually assaulted her. Vigorous cross-examination of the complainant combined with the client’s testimony wherein he denied the allegations resulted in the judge dismissing the charge.
Assault (choking) and mischief charges withdrawn
M.B. was charged with assaulting his parents and causing extensive damage to the family home. After completing counselling, his charges were withdrawn.
M.B. was subsequently charged with mischief and assault (choking) in relation to a confrontation with his roommate. After completing more counselling, his charges were withdrawn.
Firearms charges result in no criminal record
K.N. was charged with unauthorized possession of a firearm, and careless storage of firearm and ammunition. K.N. pleaded guilty to careless storage of a firearm. Defence demonstrated that he was a young man of good character, with a bright future ahead of him that would be hindered by a criminal record. The client received an absolute discharge. No criminal record.
Assault charge withdrawn after completion of counselling
L.A. was charged with assaulting her husband, who was a good-for-nothing. She was about to retire and was recovering from cancer, when she confronted him about his infidelity. He alleged she assaulted him. After completing counselling, the charge was withdrawn.
No jail for child pornography charges
J.G. pleaded guilty to possession of child pornography and received probation after completing counselling for depression and anxiety.

J.B. was charged with sexual assault by an unwanted touching of a co-worker. After completing counselling, the charge was withdrawn.
Serious driving charges withdrawn
P.A. deliberately ran over a skateboarder with his car. He attended extensive counselling that allowed him to address deep-seated anger and resentment that he was previously unaware of. Client avoided jail and received a house arrest sentence with exceptions for work, etc. In addition, he avoided a conviction for dangerous driving, which would have resulted in an automatic 1-year licence suspension.

C.B. assaulted his mother, resulting in her suffering from broken ribs. Client moved out of the house, went for family and anger management counselling. Family was reunited and C.B. went back home. Charges withdrawn.

S.B. was charged with five sets of charges that involved stalking and breaking into his ex-girlfriend’s home a number of times, harassing her, and breaching his bail conditions. After completing extensive therapy for a mental health disorder, he pleaded guilty to only one charge of breaching his bail and received an absolute discharge. No criminal record.
Assault charge withdrawn against abused wife
T.B. was charged with assaulting her husband. Defence demonstrated T.B. was in an abusive relationship, and that her husband married her to obtain immigration status. Once he obtained landed immigrant status, he took measures to break up with her, including making a false allegation. The charge was dismissed.
No jail after victim dies in house fire
W.A. was charged with criminal negligence causing death and criminal negligence causing bodily harm. The client and his wife rented out rooms in their home. The home did not have working smoke detectors, and there were other Fire Code violations. In a fire that destroyed the house, one tenant died and another was badly burned. Client avoided jail and was sentenced to a conditional sentence (a term of imprisonment served in the community) with no house arrest. W.A. was allowed out in the community with his children and to go to and from and while at work, and other exceptions.

K.A. and his co-accused were involved in a road rage incident with the complainant. The incident led to a second encounter outside a store. The complainant alleged that the co-accused stabbed him with a knife and the client hit him with a crowbar. Defence requested disclosure of video of the incident, which was captured by security cameras. The video went missing and defence applied for charges to be dismissed due to lost evidence. On trial date, charges were withdrawn.

L.A. was charged with assault by spitting on a fellow tenant in the elevator of their apartment building. This occurred during the early months of Covid. After providing character letters for the client, and after he completed anger management counselling, the charge was withdrawn.

H.R. was charged with mischief by ‘keying’ a police officer’s car. Defence challenged the strength of the crown’s case by demanding full disclosure; and analyzing the evidence, which resulted in the crown being convinced to withdraw the charge.
